Terms of Service

PlatformSmith is operated by PlatformSmith Labs Private Limited (“we”, “us”), a company incorporated in India. These terms cover your use of the PlatformSmith platform (the “Service”). By creating an account or using the Service you agree to them.

Please read section 4 carefully. It describes how responsibility is divided for actions a coding agent takes inside your own systems, which is the part of this service least like ordinary software.
1. This is a free beta
The Service is provided free of charge and is under active development. It is not a finished product. We may change, suspend, or discontinue any part of it, and we may delete data associated with your account, on reasonable notice where practical.
There is no service level agreement, no uptime commitment, and no guarantee that data you store will be preserved. Do not use the Service as the only copy or the only record of anything you cannot lose.
2. Your account
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. Tell us promptly at security@platformsmith.com if you believe your account has been compromised.
You must be at least 18 years old. Model providers set their own minimum ages, which may be higher; you are responsible for meeting the requirements of the provider account you connect.
3. Where the Service runs
PlatformSmith is a control plane. The containers that execute your code — the “runtimes” — run on infrastructure you provide and control, not ours. You are responsible for that infrastructure: its patching, its network policy, its capacity, and its isolation from the rest of your estate.
Our shared responsibility model sets out which side owns what. It forms part of these terms.
4. The agent acts with credentials you grant it
The Service runs autonomous coding agents. When you connect a credential — a Git account, a cloud account, a model-provider key — you authorise the agent to act using that credential, within the scope you granted.
You should understand and accept the following before connecting anything:
- You choose the scope, and the scope is the limit of the damage. If you install our Git application across an entire organisation, the agent can act across that organisation. Grant the narrowest access that lets you do your work. We recommend a dedicated account rather than a personal one, and specific repositories rather than an organisation-wide installation.
- The agent can be influenced by content it reads. It processes repository files, issue and pull-request text, command output, and other material that neither you nor we wrote. Content of that kind can manipulate an agent into taking actions you did not intend. This is a known and currently unsolved property of coding agents generally, not a defect specific to us. See known limitations.
- We do not warrant that the agent’s actions are correct, safe, or appropriate. The agent may write incorrect code, delete or overwrite work, push changes you did not want, or take other actions with real consequences in your systems.
- You remain responsible for reviewing what the agent does. Use the review and approval controls available to you, and do not connect credentials to production systems you are not prepared to see changed.
To the maximum extent permitted by law, we are not liable for changes the agent makes to your systems, code, repositories, or data, or for the consequences of those changes. This allocation is a condition of offering the Service for free, and it reflects that the agent runs on your infrastructure with credentials you chose.
Provider terms are yours to comply with. You represent that you hold a valid account with each model provider you connect, that you are authorised to use it, and that your use of it through the Service complies with that provider’s terms and usage policies. You are responsible for all usage and charges on your provider accounts. Credentials from personal subscription plans are scoped to the individual who connected them and may not be shared or pooled to run sessions for other people; for team or unattended use, connect an organisation API key or have each member connect their own. We do not resell, sublicense, or intermediate provider access, and we do not pay for your provider usage. Providers may change their terms, pricing, rate limits, or authentication methods, or restrict access from third-party applications, at any time and without notice to us or to you. Any of these may interrupt features that depend on them, and we are not liable for provider-side interruptions, suspensions, or account actions.
4A. What the agent produces
Output may be wrong. Agents write incorrect, insecure, or non-functional code and can be confidently wrong. Everything an agent produces needs human review before you rely on it. We do not warrant that output is accurate, secure, or fit for any purpose.
Output may resemble existing code. Models are trained on large bodies of code, and output can resemble material that is copyrighted or subject to an open-source licence with conditions you did not intend to accept. Run licence and secret scanning over generated code before you ship it. We do not warrant that output is non-infringing.
We provide no intellectual property indemnity. If a claim is made that code produced in a session infringes someone’s rights, that is not a risk we cover. Some model providers offer indemnities to their own customers, but those run to the account holder under that provider’s own terms and typically only on commercial or enterprise plans — consumer subscription plans generally carry no such protection. Because you connect your own provider account, whatever protection you have comes from your agreement with that provider, not from us. Check it before assuming it exists.
Ownership. As between you and us, we claim no ownership in code an agent generates in your sessions; it is treated as Your Content under section 5. What rights exist in it as against the wider world is a question of law we cannot answer for you — in several jurisdictions, including the United States, material generated by an AI system without sufficient human authorship may not attract copyright protection at all. If ownership of generated code matters to your business, take advice on it.
5. Your content, and what we store
You keep all rights you have in the code, prompts, and other material you bring to or generate in the Service (“Your Content”). Section 4A explains the limits of what that means for AI-generated output. You grant us only the licence needed to operate the Service for you.
We store a complete transcript of each agent session, which includes prompts, agent output, and file and command output the agent surfaced during the session. These transcripts routinely contain source code, and can contain credentials — including credentials the agent reads on its own while working, not only ones you type. Our privacy policy explains what we do with them, how long we keep them, and who can read them.
You are responsible for having the right to bring Your Content to the Service.
6. Acceptable use
Your use of the Service is subject to our acceptable use policy, which forms part of these terms. We may suspend or terminate an account that breaches it, without notice where the breach is serious or ongoing.
7. Limits and fair use
We may apply limits on storage, session volume, and other resources, and may change them. Where a limit applies to your account we will make it visible to you.
8. Termination
You may stop using the Service and ask us to delete your account at any time by writing to privacy@platformsmith.com.
We may suspend or terminate your access if you breach these terms, if we reasonably believe your use puts the Service or another customer at risk, or if we discontinue the Service. Where we discontinue the Service generally we will give reasonable notice so you can retrieve your data.
9. Disclaimer
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will produce correct results.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, or business, arising out of or relating to the Service — including, without limitation, losses arising from actions taken by an agent using credentials you granted.
Where liability cannot lawfully be excluded, our total aggregate liability arising out of or relating to the Service is limited to one hundred (100) units of your local currency, reflecting that the Service is provided free of charge.
Nothing in these terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud.
11. Changes to these terms
We may update these terms. The version and effective date at the top of this page always identify the current version. Where a change is material we will make reasonable efforts to tell account holders before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated terms.
12. Governing law
These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute arising out of them.
This does not take away rights you have under the mandatory consumer law of your own country. If you are resident in the EU, the UK, or anywhere else whose law gives you protections that cannot be contracted away, those protections continue to apply to you regardless of this section.
